Comply with legal requirements

Understand the laws that apply  when onboarding your agency’s credential to the Queensland Digital Licence app.

The legislation and policy governing the app covers:

• the ability for agencies to add credentials to the app
• how verifiers can accept a digital version of a licence as a credential.

How customers can use the app

Your customers can use a digital version of a credential to show:

• proof of their age or identity
• they hold a credential
• they are authorised to perform a certain function (for example, drive a car).

This applies any time a Queensland Act (including any subordinate instruments) requires proof of credentials. Your customer can show their digital credential in the app to comply.

The primary legislation for digital authorities contained in the Digital Licence App is provided for in Part 4E of the Transport Planning and Coordination Act 1994.

Under this legislation, a person has complied with the requirement to produce a credential (a prescribed authority), if they can produce a digital credential (a digital authority) for that prescribed authority in the approved app.

Legal authority of your credential

Digital credentials can be added to the app and are given legal authority via an amendment to the Transport Planning and Coordination Regulation 2017 to recognise the relevant:

• authority (s.11C)
• Act (s.11B) that the credential is issued under.

This means that, when the Queensland Digital Identity Services branch works with you to digitise your agency’s credentials, legislation that you administer shouldn't need to change.

We’ll confirm this as we work with you to add your credential to the app.

Memorandum of Understanding (MoU)

Onboarding onto the app

Before we onboard your credential to the app, we must enter a development MoU. This must happen before we can start any work and helps establish a positive working relationship.

The MoU defines:

• ways of working
• roles and responsibilities.

Go-live on the app

Before your credential can go live in the app, we must also enter a production MoU.

This will define how we manage your credential once in production, including:

• policies
• procedures
• responsibilities.
