Legal protection for employees

Queensland Government employees have automatic legal protection from civil liability when acting in an official capacity. See Section 26 of the Public Service Act 2008. Liability applies to the State.

You’ll receive indemnity and legal help if you’re involved in a work-related criminal proceeding, civil proceeding, inquiry or investigation. See the Queensland Government indemnity guideline.

Protection only applies if you act in an official work duty, in good faith and without gross negligence. The Queensland Government can recover funds or withdraw support if you have not acted in good faith, been negligent or found guilty in a criminal proceeding.
