Public authorities

Original and receiving public authorities under s17 of the Public Records Act 2023

Under the Public Records Act 2023, where a public authority will cease or has ceased to exist (the original public authority), the original public authority must give control of any public record of the authority to the receiving public authority as follows:

• if the public authority is a Commission of Inquiry, control of the public records of the inquiry should be transferred to the department with responsibility for administering the Commissions of Inquiry Act 1950
• if a function is to be carried out by another public authority, control of the public records should be transferred to the public authority taking over the function
• otherwise, the State Archivist may decide which public authority should be given responsibility for public records, including the State Archivist.

When the State Archivist decides which public authority should be given responsibility for public records, a list must be kept and published below stating the original authority and the receiving public authority.

Relevant and responsible public authorities

Where a public authority ceases to exist and no other public authority will take over the functions of that public authority, records will be given to the State Archivist or another public authority (known under the repealed Public Records Act 2002 as the relevant public authority) decided by the Archivist to manage and make decisions about restricted access periods and access to restricted records in the custody of QSA (known as the responsible public authority under the repealed Public Records Act 2002).
