Access the Social Traders' portal

The Queensland Procurement Policy 2023 requires government buyers to apply a responsible public procurement approach to their procurement activities.  This includes using their procurement activities to deliver added social outcomes that are consistent with government objectives.

An effective way government buyers can deliver added social outcomes is by increasing spend with genuine, quality social enterprises.

To help government buyers find social enterprises, we have partnered with Social Traders to access their database of certified social enterprises (the Social Traders’ portal).

This portal is open to all employees and contractors in:

  • Queensland Government departments
  • government-owned corporations
  • statutory bodies
  • special purpose vehicles

Department Terms of Use for the Social Traders Portal

The State of Queensland (Represented by the Department of Energy and Public Works) (we/our/us) has procured access to the Social Traders Portal and has the right to share access to the Social Traders Portal with all employees or contractors from other Queensland Government agencies, statutory bodies, special purpose vehicles and Government owned corporations (you).

The Social Traders Portal (‘Portal’) is a website owned by Social Traders Ltd ACN 132 665 804 (‘Social Traders Ltd’) which provides access to the database of certified social enterprises managed by Social Traders Ltd. To avoid doubt, a reference to the Portal in these Terms and Conditions is also considered to be a reference to the database of certified social enterprises.

If you access and use the Portal, you agree to the Department Terms of Use for the Social Traders Portal.

We may change the Terms and Conditions from time to time. The date on which the Terms and Conditions have been last updated will appear at the top of this page. You agree and acknowledge that you accept these Terms and Conditions each time you log into and use the Portal.

Using the Social Traders Portal

You acknowledge that we have provided you with generic Portal log in details which may be used to access the Portal.

In using the Portal, you must:

  • Comply with any directions from us or Social Traders Ltd in respect of use and access to the Portal, including any directions on our site, Social Traders site, or on the Portal;
  • Comply with any terms of use imposed by Social Traders Ltd for the Portal;
  • Comply with all laws that apply to you concerning your use of our site, Social Traders site, and use of the Portal;
  • Keep your Portal username and password details secure and do not disclose the log in details to any third party; and
  • Not disclose any information obtained via the Portal to a third party.

Personal Information

You acknowledge that Social Traders Ltd will collect your personal information when you log into the Portal using the log in details. You provide consent for us to collect and use your personal information held by Social Traders Ltd to confirm whether you have accepted these Terms and Conditions, or to investigate a breach by you of these Terms and Conditions.

Security

We take all reasonable precautions to ensure that our site is secure, but we cannot guarantee its security. You must comply with any instructions we give you from time to time concerning the security of our site.

You acknowledge and agree that the department cannot guarantee the security of the Portal. You must comply with any instructions given by Social Traders Ltd from time to time concerning the security of its site.

Links

You acknowledge that we do not have control over the content of the Portal which is made available to you upon agreeing to these Terms and Conditions, or to the changes that may occur to the content on that website.

The link to the Portal does not indicate any endorsement by us of the website or of the information, products or services provided at the website. You access the link at your own risk.

We do not warrant that any website, including any third-party application store, is free from any viruses or malicious software or code which may be transmitted to a mobile device in connection with the download, installation or use of the app.

No warranties or representations

To the maximum extent that the law permits, we do not represent or warrant that the content on the Portal is accurate, reliable, suitable or complete.  We cannot promise that the Portal will be continuously available or virus or fault free.

Disclaimer

We disclaim all responsibility and all liability (including without limitation, liability in negligence) for all expenses, losses, damages and costs that you might incur as a result of or in connection to your use of this site and your access (or lack thereof) and use of the Portal.

Intellectual Property

You acknowledge that Social Traders Ltd owns the intellectual property in the Portal. You must not do anything that would breach the intellectual property rights of Social Traders Ltd in respect of the Portal.

We have been granted a perpetual licence from Social Traders Ltd to use the Portal. By accepting these terms and conditions, we grant you with a non-exclusive, non-transferable, revocable sub-licence to use the Portal. The licence granted under this clause will expire on 30 June 2024, unless otherwise notified by us. This sub-licence will be revoked immediately if we, at our sole discretion, revoke your access to the Portal.

Indemnity

You will release, discharge and indemnify us from and against any claim made by any third party, including Social Traders Ltd, concerning:

  • your breach of these Terms and Conditions;
  • your breach of any terms of use imposed by Social Traders Ltd for the Portal;
  • your infringement of any third party’s rights, including intellectual property rights;
  • your infringement of our intellectual property rights;
  • any use by you of information obtained via the Portal;
  • your negligent or unlawful act or omission; or
  • your contravention of any law,

except to the extent that the claim is due to our negligent or unlawful act or omission.  In this clause, ‘claim’ includes any claim, action, proceedings, demand, liability, obligation, costs (including legal costs), losses, damages and expenses, including those arising out of the terms of any settlement.

Period of Access

You acknowledge that access to the Portal is for the period 15 June 2020 to 30 June 2024. We may remove your access earlier for any reason whatsoever. We will not be liable to pay any compensation or damages for early removal of your access.

General

If there is an inconsistency between these terms and other terms on our site, the other terms will govern to the extent of the inconsistency.

If you or we do not act concerning a breach of these terms, this does not waive any rights to act concerning that breach or any later breach.

If any part of these terms of use are determined to be invalid, unlawful or unenforceable for any reason then that part, to the extent of the invalidity, unlawfulness or unenforceability, will be severed from the rest of the terms of use and the remaining terms and conditions will continue to be valid and enforceable to the fullest extent permitted by law.

The law in force in the State of Queensland governs these terms.
