Use of the same or similar questions in recruitment processes

Overview
An employee, who was interviewed but unsuccessful for a position, became aware that several of the questions used in the interview process had been used in an interview process for the same position previously. The employee appealed the promotion decision on the grounds that the successful applicant had an unfair advantage having been asked largely the same questions for the same position previously.
The agency submitted that they had reviewed the questions and consequently made some changes, but that it was appropriate to leave the questions largely unchanged because the recruitment process was for the same workplace with the same environmental challenges and limitations.
Decision
The recruitment process undertaken by the agency was found to be fair and reasonable in the circumstances.
The Appeals Officer considered that the questions were primarily generic in nature and were expected for the type of role. There was no suggestion that the successful applicant would have been aware that similar questions would be used in both interview processes.
The Appeals Officer determined that it would be unrealistic for the agency to attempt to find alternative questions where the position had remained the same. Further, interviewees should not have their responses discounted to their detriment because they have reapplied for a position on a separate occasion.
Implications for agencies
Agencies should review questions for each recruitment process, however there is no obligation to change questions if they remain appropriate to ascertain the relevant attributes for a role.
Where set questions are used they can be supplemented with further discussion to best understand how a persons experience and skills would contribute to them successfully performing the role.
